Terms of Service

The items sold through Ya Ge E-Shop is provided by Ya Ge (“we”, “us” “our”) Pte Ltd, a Modern Chinese at Level 3, Orchid Hotel, 1 Tras Link Singapore 078867. Any orders made through this online shop are made between the individual making the order (“You”) and Ya Ge. The order is subject to the local terms and conditions and privacy policy imposed by Ya Ge.

By placing an order, you agree to the following terms and conditions:

Pricing
▪ Prices listed are in Singapore Dollars, and subject to prevailing goods & services tax.
▪ Prices and information are correct at time of publishing and may change without prior notice.
▪ Discount is applicable on items before prevailing government taxes.
▪ Delivery Fee, when applicable, will be charged at the rates indicated in Terms and Conditions, and calculated at order check out.

Acceptance and Confirmation of Order
▪ Advance order of 3 days and full pre-payment is required.
By confirming your order, you acknowledge the order placed to be correct and responsible for the payment incurred, including delivery fees if applicable.
▪ We reserve the right to reject or cancel any order, alter or modify order details due to availability of item, ingredients or to conform to the restaurant’s practices/polices.
▪ In the event an order is rejected, we will notify you of that rejection and the reason for rejection via email within three (3) business days after the placement of the order.
▪ When we reject an order and your payment for the Order has already been processed, we will refund any money paid to us in respect of that order and make reasonable endeavours to process the refund within ten (10) business days. Your receipt of your refund will depend on the period of time it takes your financial institution to finalise the refund. We are not involved in any respect to any loss you or any third party might suffer as a result of any delay in processing your refund.

Cancellations and Refund
▪ Once an order is paid and completed, the order cannot be cancelled or amended and no refund will be entertained.
▪ No exchange of food items once collected or delivered, unless the item is defective upon receipt, damaged during delivery or the wrong item was sent. We encourage you to check your order upon receipt. In such an event, please notify us immediately at Tel: +65 8031 6831 or email: yage@orchidhotel.com.sg and, we will, at our discretion exchange the item.

Delivery and Self Collection
▪ Orders are available for delivery and self-collection from 11am to 2.30pm and 5pm to 8.30pm daily (except for CNY Eve 11am to 2pm only).
▪In the event due to unforeseen circumstances, you need to change your schedule timing, email us your order number at yage@orchidhotel.com.sg 48 hours before the appointed date and time.
▪ Self-Collection must be collected at the stipulated time of the date chosen. Any perishable food items ordered not collected, order will be void and no refund will be given.
▪ Complimentary delivery to a single location in Singapore (excluding all off-shore island except Sentosa) is available for orders of S$500nett and above.
▪ Deliveries are available at S$50nett per location for orders below S$500nett.
▪ Additional surcharge of S$30nett will apply for delivery to Sentosa.
▪ Deliveries will be scheduled according to the date and time slot selected during checkout.
▪We use third-party delivery partners to deliver your orders. Our third-party delivery partners will endeavour to deliver your order within the indicated time frame, please note delivery times stated are estimates only and not guaranteed.
▪Delivery times are estimates and delay may occur due to weather, road conditions or other unforeseen circumstances.
▪ In the event that any delivery is unable to be fulfilled at the specified address given due to any reason (e.g. unable to contact you, the assigned receiver no show, no entry to premise etc), the assigned delivery personnel will only wait for a maximum of 10 minutes at the delivery location. The food items will return to restaurant and can be collected during operating hours. Arrangement for re-delivery will be subject to slot availability and a new delivery charge.

Payment
▪ Online payment is made exclusively by the appointed payment gateway Shopify Pay.
▪ Ya Ge uses third party providers to securely store your payment card information and process your payments to restaurant. You understand and agree that, when you register a payment card, Ya Ge or its third-party providers may verify that the payment card you registered is valid. You also understand and agree that when you use ordering to make a purchase from Ya Ge E-Shop, that Ya Ge will be the merchant of record. We may require information other than your order code to verify your purchase. You represent and warrant that you are of sufficient age and have all legal rights to use all payment cards you register.
▪ You acknowledge agree and consent that your personal data such as your name, credit card number and card expiry date and the mobile numbers, may be disclosed to third parties (located within and outside of Singapore) processing such cashless payment transactions, including credit card companies, banks and payment gateways provider, and, subject to their respective personal data privacy policies and applicable laws, may be used, processed and stored by such third parties to facilitate payments that you now or subsequently make for orders placed.
▪ Once a transaction is complete, we may hold a reference to the credit card used (i.e. first 6 and last 4 digits of the card) and the mobile numbers (for mobile payment), which is held against your order transaction details and for any card/bank promotions.

Intellectual Property
▪Any texts, remarks, structures, illustrations and images reproduced on the website are controlled and regulated by copyright as well as by intellectual property throughout the whole world.
▪ Any reproduction of the website, whether in whole or in part, is strictly prohibited.

Privacy Policy
▪ Your privacy is important to Ya Ge, please read through the Terms and Conditions before providing us your personal information.
By placing an order, you confirm that you authorize, agree and consent to Ya Ge collecting, using, disclosing and/or processing personal data about you as provided for facilitating, processing, dealing with, administering, managing such order and payment for order placed, and agree to the Privacy Policy for Ya Ge.

Limitation of Liability
▪ Ya Ge reserves the right to change the food items availability at any time, without prior notice.
▪ Ya Ge reserves the right to replace a food item that became unavailable after an order is placed with another food item of equivalent or higher in value.
▪ You agree to submit to the exclusive jurisdiction of the courts of Singapore regarding any such dispute.
▪ A person who is not a party to the Terms and Conditions shall have no right under the Contract (Rights of Third Parties) Act to enforce any part of the Food Terms and Conditions.
Ya Ge may vary the Food Terms and Conditions from time to time and any use or continued use of the Site shall be deemed acceptance of the Food Terms and Conditions.
Ya Ge reserves the sole and absolute right and discretion in making any decision in response to any dispute. Any decision made by Ya Ge is final and further appeals and/or disputes will not be entertained.
